Terms for using the Gapex platform.

Welcome to Gapex. These Terms & Conditions (“Terms”) govern your use of the Gapex platform and services provided by Gapex (“we”, “our”, or “us”).

These Terms apply to our website and platform available at: https://gapex.ai/terms

By accessing or using Gapex, you agree to be bound by these Terms.

1. About Gapex

Gapex is a software platform designed to help businesses manage social media communications using automation and artificial intelligence. The service allows users to connect social media accounts, monitor posts, manage comments and direct messages, and generate AI-assisted responses.

2. Eligibility

To use Gapex, you must be at least 18 years old and have the legal authority to manage any social media account you connect to the platform. The service is intended primarily for business or professional accounts.

3. Account Registration

Users access Gapex through supported social media login methods. You are responsible for maintaining the security of your account and for all activities conducted under it. You agree to provide accurate and up-to-date information.

By connecting a social media account, you authorize Gapex to access certain information through official APIs, including posts, videos, comments, direct messages, and usernames. Your use of those platforms remains subject to the terms and policies of the respective providers. In particular, Gapex uses YouTube API Services to provide its YouTube features. By using Gapex’s YouTube features, you agree to be bound by the YouTube Terms of Service, available at https://www.youtube.com/t/terms. You also acknowledge that Google’s Privacy Policy (http://www.google.com/policies/privacy) applies to your use of Google services accessed through Gapex. You may revoke Gapex’s access to your Google account at any time at https://myaccount.google.com/connections?filters=3,4&hl=en.

5. Acceptable Use

You agree not to misuse the service. Prohibited activities include violating laws, sending spam or abusive messages, attempting to access unauthorized data, or interfering with the platform’s operation. When using Gapex’s YouTube features, you also agree to comply with the YouTube Terms of Service and YouTube’s Community Guidelines (https://www.youtube.com/howyoutubeworks/policies/community-guidelines/).

6. AI-Generated Content

Gapex may generate automated responses using artificial intelligence technologies. These responses are suggestions and may not always be accurate or appropriate. Users are responsible for reviewing and approving generated content before publishing.

7. Subscription and Payments

Gapex operates under a subscription-based pricing model. Fees depend on the selected plan. Failure to pay subscription fees may result in suspension or termination of the service.

8. Data Ownership

Users retain ownership of their social media content. By using Gapex, you grant us a limited license to access, process, and store the content solely as necessary to provide the service to you, in accordance with the consent you have granted via the connected platform’s authorization flow. Gapex does not use content obtained via YouTube API Services to train machine learning models or for any purpose beyond providing the requested service to you.

9. Service Availability

While we aim to maintain reliable service, Gapex does not guarantee uninterrupted availability. Maintenance, updates, or technical issues may occasionally affect access to the platform.

10. Limitation of Liability

To the maximum extent permitted by law, Gapex shall not be liable for indirect damages, business losses, or consequences arising from the use of AI-generated responses or third-party platform restrictions.

11. Termination

Gapex reserves the right to suspend or terminate accounts that violate these Terms or misuse the platform. Users may also stop using the service and request account deletion at any time.

12. Changes to the Terms

These Terms may be updated periodically to reflect changes in services, technology, or legal requirements. Continued use of the platform after updates constitutes acceptance of the revised Terms.

13. YouTube API Services

Gapex uses YouTube API Services to provide its YouTube comment management and AI-assisted reply features. By connecting your YouTube channel and using these features, you also agree to be bound by the YouTube Terms of Service (https://www.youtube.com/t/terms) and the Google Privacy Policy (http://www.google.com/policies/privacy).

13.1 Data accessed via YouTube API Services

When you connect your YouTube channel via Google OAuth, Gapex accesses: your channel ID and basic channel information, the list of videos uploaded to your channel, comment threads on your videos, and the replies you choose to post. Gapex posts replies to YouTube only after you approve them.

13.2 Storage, cookies, and similar technologies

Gapex stores OAuth access and refresh tokens, channel metadata, your videos and comment data, and the AI-suggested and approved replies, in our secure database. Gapex also uses cookies and similar technologies in users’ browsers and devices to maintain sessions, remember preferences, and operate the platform. Third-party services we use (authentication, analytics, infrastructure providers) may also place cookies on your device.

13.3 How to delete your YouTube data and revoke access

You may delete your stored YouTube data and/or revoke Gapex’s access to your Google Account at any time: In-app: Open Gapex → Settings → Connected Accounts → YouTube → Disconnect & Delete Data. This calls Google’s token revocation endpoint and deletes your stored YouTube-derived data within 30 days. Via Google: Visit https://myaccount.google.com/connections?filters=3,4&hl=en and revoke Gapex’s access. Once revoked, our stored authorization tokens become invalid and we will delete your YouTube-derived data within 30 days.
